Carlo Ruta è un giornalista siciliano, e scrive in un blog, il suo. Anzi “scriveva” perché è stato chiuso.
L’8 maggio scorso è stato condannato (leggi la sentenza) dal Giudice penale, per il reato di stampa clandestina previsto dall’art. 16 della legge sulla stampa del 1948 per non aver eseguito la registrazione del proprio sito web www.accadeinsicilia.net presso la cancelleria del tribunale. Trattasi di una disposizione di legge del tutto fuori tempo e inconciliabile con le nuove forme di comunicazione introdotte con la rivoluzione portata dalla Rete. Soprattutto deve ritenersi incostituzionale perché il diritto di informare la costituzione lo riserva a tutti e non solo alla carta stampata che ha registrato il proprio marchio al tribunale.
L’onorevole Giulietti, deputato eletto nell’ Idv e portavoce dell’associazione Articolo 21, ha già chiesto al Ministro della giustizia tramite un'interrogazione a risposta scritta di rivedere la disciplina della materia affinché non si lasci spazio alla censura.
Quanto accaduto è un atto grave, anzi gravissimo ed è accaduto in una regione dove l’omertà è l’humus su cui cresce e prolifera l’arroganza della malavita organizzata.
Sia chiaro, la colpa non è del giudice che ha dovuto applicare la legge, ma del legislatore che quando gli fa comodo finge di non vedere alcune norme desuete e superate.

Non basta. Ho disposto il deposito di un'ulteriore interrogazione affinché venga accelerato il processo di revisione della legge.

I support Carlo Ruta
Carlo Ruta is a Sicilian journalist and he writes a blog, his own.
Well, in fact, “he wrote” because it has been closed down.
On 8 May he was convicted (read the judgement) by the judge in the criminal court, for the crime of “clandestine printing” as laid down in article 16 of the 1948 law on printing for not having carried out the registration of his website www.accadeinsicilia.net at the office of the tribunal. It is a legal requirement that is completely outside its timeframe and incompatible with the new forms of communication that came in with the revolution brought about by the Internet. Above all it must be considered unconstitutional because the right to inform is reserved by the Constitution for all and not just for the printed paper that has recorded its brand name at the tribunal.
The honourable Giulietti, a deputy elected with IdV and spokesperson for the association “Articolo 21” has already asked the Minister of Justice by means of a question requiring a written answer to review the discipline on this subject so that the doors of censorship are opened.
What has happened is a serious action, in fact really serious and it happened in a region where “omertà” is the fertilizer in which the arrogance of organised crime grows and flourishes.
Let it be clear, the fault does not lie with the judge who has been obliged to apply the law, but of the lawmaker who when it is convenient pretends not to see certain regulations that are obsolete and out of date.

But that’s not enough. I have arranged for the deposition of another question so that the process of reviewing the law is speeded up.
